| Tokyu Hotels Comfort Members: Member Rules
|
|
|
| 1. Membership This membership organization shall be named "Tokyu Hotels Comfort Members" (hereinafter called "Comfort Members") and shall be administered by Tokyu Hotels Co., Ltd. (hereinafter called the "Company"). Members shall be guests using any member hotel of Tokyu Hotels (please visit our website for a list of member hotels) under the Terms and Conditions of the Accommodation Contracts and who register for membership after agreeing to the Tokyu Hotels Comfort Member Rules in accordance with the admission procedures specified in Article 2. | |

| 2. Registration Registration shall be accepted by either of the following methods:
| (1) | | At any member hotel of Tokyu Hotels
Please submit the completed application forms with the registration fees specified in Article 3 to any member hotel of Tokyu Hotels. Member cards shall be immediately issued, and the issuance of member cards shall mean that applicants have formally been registered. Please note that the applicants may be asked to verify their identity. |
| (2) | | At the website of Tokyu Hotels (hereinafter called "our website")
After entering the necessary information on the designated application forms via our website, please pay the registration fees specified in Article 3 in accordance with the method set forth on the website. Upon completion of the registration procedure, applicants shall be deemed to have been formally registered. |
| (3) | | By postal application
Send the completed application forms by postal mail to the address of the Tokyu Comfort Members Office (hereinafter called the "Office.") The completion of acceptance procedures after the arrival of the postal application shall be regarded as formal registration. Registration fees specified in Article 3 shall be remitted through bank transfer or paid at any member hotel of Tokyu Hotels. |

| 3. Registration Fees When registering, applicants shall pay five hundred (500) yen as registration fees (tax included). No payment of annual membership fees shall be required. Please note that the registration fees shall not be refunded regardless of whether the services are used, withdrawal from membership, or for any other reasons. | |

| (1) | | Issuance of Membership Cards
Tokyu Hotels Comfort Members Cards with membership numbers printed on the surface (hereinafter called "Membership Cards") shall be issued to Members. |
| (2) | | Members may not lend, transfer, nor pledge the Membership Cards or members' privileges to any other persons. |
| (3) | | Notification of loss or re-issue
Please report the loss or damage of the Membership Cards to the nearest Tokyu Hotel or the Office at your earliest convenience; membership cards will be re-issued at a cost of five hundred (500) yen (tax included). The Company shall not be liable for any compensation due to loss or damage of a membership card. |

| 5. Member Privileges
The Usage Guide and Basic Privileges separately set forth shall apply to Members when they use any member hotel of Tokyu Hotels. Please be sure to present Membership Cards when using member privileges. Please note that member privileges may not apply if a Member fails to present the Membership Card (please also present Membership Card when making a reservation via our website). | |

| 6. Membership Termination Memberships may be terminated if members fall under any of the following. Upon disqualification for membership, all accumulated points shall expire. Please note that no notifications about termination shall be sent from the Company to the Member:
| (1) | | Applicants make a false declaration at the time of admission; |
| (2) | | Members' addresses, telephone numbers, or any other means of communication become unavailable; |
| (3) | | Members fail to pay any charges, including accommodation charges, in accordance with the Terms and Conditions of Accommodation Contracts. |
| (4) |
| Members harm or damage other hotel guests, hotels (facilities, equipment, furniture and fixtures, incidental facilities, or buildings and structures in the hotels' premises), or hotel employees without compelling reasons, regardless of how such harm or damage may have been handled thereafter. |
| (5) |
| Members damage the reputation of other Members or disturb the good order of Comfort Members; |
| (6) |
| Members fail to observe the Terms and Conditions of Accommodation Contracts and the term of Service Use Regulations; |
| (7) |
| Members have committed any criminal acts; |
| (8) |
| The Office determines members to be inappropriate. |

|
7. Membership Withdrawal Members falling under any of the following shall be withdrawn. Upon withdrawal from Membership, all accumulated points shall expire: |
|
| (1) | | Members notify in person of withdrawal from Membership; |
| (2) | | Services are not used by Members for a period from the last date of use (no addition or use of points or no accommodation at the Comfort Members' rate) until the end of the year after next. |
| (3) | | Members are deceased. |

8. Changes in Registration Members shall notify the nearest Tokyo Hotel of changes in their addresses, names, or telephone numbers. These changes may be accepted via our website. |

| |
| 9. Handling of Personal Information
| 1. |

Gathering and retention
The Company may gather and register personal information on Members within the following limits. Some information, which is not required or described at the time of admission, may not be retained:
|

Personal information registered at the time of admission or via our website:
Name, home address, home phone number, gender, birth date, company name division within the company , job title, address of the company, telephone number of the company, address where information will be sent, mail address, need/no need for mail news, newspaper preference, smoking/non-smoking, wedding anniversary, date of member registration, and membership number.

Information on transactions from the use of Membership cards:

Objectives for Use
The Company and each member hotel of Tokyu Hotels shall make joint use of personal information specified in Paragraph 1, Article 9 of the Member Rules. The objectives for joint use of personal information are as follows:

Assessment of administering Members and utilizing member benefits
|
|
(2) |
Delivery by direct mail and/or e-mail of the latest information, promotional information, and product/service information offered by Tokyu Hotels
*Information about products and services offered by the member companies (please visit our website for a list of companies) and affiliates of Tokyu Group may be sent through the Tokyu Hotels.

| 3. |

Monitoring of contractors
The Company and member hotels of Tokyu Hotels may entrust third parties, with whom a confidentiality agreement to protect personal information has been concluded, to provide a variety of mailing services to Members. When outsourcing, the Company shall obligate such contractors to strictly control the personal information, and the Company shall monitor the control implemented by contractors.

Disclosure to third parties
Personal information of Members shall not be disclosed to third parties except as follows:

(1) |
Agreed by the applicable Members;
|
|
(2) |
As required by public offices pursuant to laws and regulations
|
|
(3) |
As requested by law enforcement to cooperate with an investigation
|

| 5. |
|
Disclosure, amendment, and deletion
Members are entitled to ask the Company to disclose personal information about themselves. Should the contents of the registration be proven inaccurate or in error, the Company shall promptly agree to make the amendments or deletion as requested.

Discontinuation of use of information, direct mailing, and/or e-mail delivery
Although the Company uses the applicable information within the limit specified in Paragraph 1 and 2 of Article 9, it shall take action to discontinue the use, direct mailing, and e-mail distribution of personal information if such discontinuation is requested by Members.

For inquires about the disclosure, amendment, or deletion of personal information or notification about the discontinuation of the use of personal information, please contact the Tokyu Comfort Members Office at (81)3-3477-6264. Business hours 09:00 - 18:00 (Closed on weekends and holidays)

| 10. Amendment to Rule The Company may change the Member Rules (including Member Privileges and the hotels offering Member Privileges) without prior notice. When using the Tokyu Hotels, please check the latest Rules at our website or at each member hotel. | |
|
|
11. Termination of the Member Organization Members may be terminated upon prior notice to that effect. |
|
|
|
| 12. Governing Law The Member Rules shall be solely governed by the laws and regulations of Japan. |
|
|
| 13. Jurisdiction Agreement With respect to any and all lawsuits arising between any member and Comfort Members, the Tokyo District Court shall have exclusive jurisdiction in the first instance. | | |
| 14. Supplementary Provision The Member Rules were revised as of January 2008. | | |
